Testimonies of Cases of Gender Violence

Testimonies of Cases of Gender Violence

Case 1: Milagros Rumiche (Tumbes)

In September from 2016 in Tumbes, Milagros Rumiche a young women suffered from physical violence from his ex ex-partner and father of her son, Carlos Feijoo Mogollón. She was abandoned in a camp after being abused and savagely beaten, having injuries in her nose, arms, mouth and a broken neck. She was interned in a hospital in Tumbes for a lot of  months because of her serious injuries. The aggressor fled and the PNP (Policía Nacional del Perú) captured him after three months of the terrible day. After one year, the Supraprovincial Permanent Collegiate Court of the Superior Court of Justice of Tumbes sentenced Carlos Feijoo to 10 years in prison for the crime of attempted femicide.

Happily Milagros Rumiche could recover and she was interviewed by some national channels to speak and advise other women to report any physical, psychological or domestic abuse against them. She also said: "I want to thank the Minister for Women, the director of the hospital, the doctors, the security personnel, my parents and God because, thanks to him, I am here. I am proud of my son and my family, they give me strength”.

Case 2: Azul Rojas Marín

In the early hours of February 2008, Azul Rojas Marín, a transgender Peruvian who was then a homosexual man, was detained by three policemen. The reason was to verify his identity since Marín did not have documents. They proceeded to take her to the police station in the city of Casa Grande, located on the north coast of Peru. It was there, at the police station, where she was physically, sexually and verbally assaulted, using homophobic phrases. The "Center for the Promotion and Defense of Sexual and Reproductive Rights” (Promsex in its acronym in Spanish), assures that: "They touched her and undressed her by force. While two of them held her arms and legs, a third inserted a rubber wand into his rectum on two occasions, causing bleeding injuries." After a few hours she was released. That same day, Marín went to the media and the prosecution. She denounced the three policemen for rape, abuse of authority and torture. But the Prosecutor's Office dismissed the charge for torture and, in January 2009, the Judiciary closed the lawsuits for rape and abuse of authority. At this point, Marín, without having justice within the country, seeks to go to international instances. With the help of different protection and human rights organizations, he manages to have his case processed in The Inter-American Court of Human Rights (IACtHR).

In 2018, after 10 years of a tough legal battle, the Inter-American Court of Human Rights (IACtHR) found Peru responsible for the torture and sexual violence against an LGBTI person by police officers. This fact became the first time in history that the IACtHR, the last authority on human rights in America, considered a case of discrimination. After the result, Marín indicated: “I am very grateful to all the people who have made this possible. I have no words to describe how I feel… After everything I've been through, finally a court believes my word…”

Case 3: Hector Valer

In 2016, former Minister of State Hector Valer Montoya was accused of family violence by his wife Ana Montoya and their daughter Catherine. The judiciary indicated in the medical certificate of the aforementioned complainants that "there were indicators of corporal abuse in the aforementioned persons, presumably coming from the accused Hector Valer Pinto."
In the complaint filed by Catherine, she indicated that she was attacked by her father, "who slapped her, punched her, kicked her in the face and different parts of her body, and pulled her hair," Ana Montoya added that her husband "punched her in the the face and a push against the ground”. The neighbors of Hector Valer Montoya indicated that shouts and rudeness were always heard at his home to the detriment of his wife and daughter.
On February 8, 2017, the 9th Family Court of Lima issued protective measures in favor of the woman and prohibited Valer Pinto from "any conduct that constitutes violence and/or harassment against Ana María Montoya Leo, under threat of being criminally denounced for the crime of disobedience or resistance to authority.

Case 4: Nuria Villanueva Zafra

In 2020 amid the pandemic Nuria Villanueva Zafra suffered from violence, she related the following: In 18 years of marriage I suffered psychological, economic and physical violence until I finally decided to get my husband out of my life. His family justified not paying alimony because they said that I had kicked him out. When I asked him for money for his children's books, he replied: "You don't know who you messed with or what awaits you, donkey." Besides, he kept me captive for 24 hours in the house where we lived, he wouldn't let me go out, neither to buy nor to see the sun, until I was able to flee at dawn. In my isolation and recovery process I reported it to the authorities, but nothing happened. An activist friend put me in touch with other feminists who helped me with everything; I made three more complaints against the guy, but the police didn't even take it into account. Of course, we support each other. There I learned, I lived the sorority and I embraced my convictions. He's free, but we're not going to let him hurt anyone else. I had the courage to denounce the violence that happened to my ex-husband, not only in my private life, but in the institutions, because since I set foot in the offices of the Public Ministry they questioned me why I denounced "if that already had weather". They told me that if he was sure, they could put him in jail and then we women would change our minds. Finally I told them: if I were a man, would they be asking me the same thing?

The other face of violence: violence against men

In the Peruvian society, it is not very common to hear about violence against the male gender, since there are more cases related to violence against women and there is a stereotype that associates men with self sufficiency, strength and insensitivity. We still cannot deny the fact that men suffer from different types of violence too. In 2018, in the country, 15% of the complaints made for domestic violence were made by men mistreated by their partner. Normally, men do not report these acts because they feel ashamed and/or are afraid that the authorities will not believe them. In the case of men; children, adolescents and older adults are the ones who suffer the most. The forms of abuse are physical, psychological, and sexual. Also, this affects the family environment and causes posttraumatic stress disorder, depression, anxiety atacks and even suicide.  With the city of Lima leading the rate of domestic violence against men with 1,111 cases so far this year, followed by Arequipa w...

Gender violence against the LGTB community

According to the World Bank Organization, 70 countries around the world consider homosexuality illegal, and there is no social acceptance of this community at all. There are exclusions, arrests, and even the death penalty against them. This is alarming because there is a lot of discrimination and violence against people, based on their sexual orientation, and this affects them not only physically but psychologically. In Peru, most LGTB people live with the fear of being attacked, and they can't be themselves or show their real identities because we can see this rejection everywhere; in schools, universities, supermarkets, other social places, etc. Their sexual orientation affects them when getting a job and being with their families too. All the above-mentioned is called gender-based violence. But why does it occur in the first place? According to Mr. Vimal Makwana (2020), LGTB people face higher rates of hate-motivated violence, which take the form of stigma, marginalization, and ...

Realistic perspective of violence against women in Peru

Violence against women is any action against them based on their gender. This can be physical, sexual, psychological abuse or even death, called femicide. It is devastating how many cases of this type of violence we have in Peru, where women live with fear every time they leave their homes, despite the fact that their own house is not a safe place sometimes.  National statistics give us a more realistic perspective of this situation. According to the National Institute of Statistics and Informatics, in the first 10 months of 2021 around 117,414 cases of violence against women were handled, which represents an increase of more than 69% compared to the same period in the previous year. Ipsos says that sexual violence, sexual harassment and physical violence are the three main problems faced by women and child girls. In 2021, according to the National Program for the Prevention and Eradication of Violence against Women and Members of the Family Group (Aurora), psychological violence w...
